1. Definitions
- "Nurtura" / "we" / "us" / "our" refers to the business operating under the name Nurtura, based at No. 62, Jalan Padungan, 93100 Kuching, Sarawak.
- "Client" / "you" refers to the adult who books and receives one or more of Nurtura's services.
- "Services" refers to the Household Documents Stocktake, the Caring Together Workshop for Adult Siblings, and the Family Continuity Programme, as described on our website and in written service descriptions provided before each engagement.
- "Written output" refers to the document index, written plan, workbook, template pack, quarterly review notes, or annual handover pack produced as a result of a service engagement.
- "Agreement" refers to these Terms and Conditions together with any written service description accepted by the Client.
2. Acceptance of Terms
By booking a service with Nurtura — whether by telephone, email, or the contact form on our website — you confirm that you are aged 18 or over, that you have the capacity to enter a service agreement, and that you have read and accept these Terms and Conditions.
Nurtura reserves the right to decline a booking for any reason without obligation to provide an explanation.
3. Service Description and Scope
Nurtura provides organisational and educational services to households. A written scope description is provided and must be acknowledged before the first appointment of any service. The scope description states what is included in the service and what is excluded.
Nurtura's services are administrative and educational only. Nothing produced by Nurtura — including document indexes, written plans, workbooks, template packs, or handover packs — constitutes legal, financial, healthcare, counselling, or any other form of professional advice. Where a matter falls outside Nurtura's scope, it is noted in writing with the category of professional appropriate to handle it.
Services are available to households in Malaysia. Appointments are conducted primarily in and around Kuching, Sarawak. Workshop sessions may be delivered online for participants outside the Kuching area, subject to prior arrangement.
4. Client Responsibilities
You agree to:
- Provide accurate information when booking and during service delivery
- Be available at the agreed time and location for appointments
- Notify Nurtura at least 48 hours in advance if you need to reschedule an appointment
- Use written outputs for lawful household organisational purposes only
- Not share written outputs in a way that misrepresents their nature or the scope of Nurtura's services
5. Intellectual Property
Written outputs produced as part of a service engagement are provided to you for your household's use. Template packs and workbooks provided in the Caring Together Workshop may be used within the client's immediate family group but may not be reproduced for commercial purposes or distributed to others outside the household.
The Nurtura name, logo, website content, and methodology documents remain the property of Nurtura.
6. Payment
All prices are stated in Malaysian Ringgit (RM) and are all-inclusive unless a written amendment has been agreed. Prices at the time of booking:
- Household Documents Stocktake: RM 470 per appointment
- Caring Together Workshop: RM 1,720 per participant (all five sessions)
- Family Continuity Programme: RM 4,400 for twelve months
Payment is due before the first appointment of any service. Nurtura accepts bank transfer and, where available, other payment methods confirmed in writing at the time of booking.
Cancellations: Cancellations made more than 48 hours before a scheduled appointment will receive a full refund. Cancellations made within 48 hours of a scheduled appointment will not be refunded, though the appointment may be rescheduled once at no additional charge. Workshop fees are non-refundable once materials have been dispatched or the first session has taken place.
7. Service Delivery
Written output is delivered within three working days of each appointment unless otherwise stated in the service description. Quarterly review outputs under the Family Continuity Programme are delivered within five working days of each review meeting.
If Nurtura is unable to deliver a service due to circumstances beyond our reasonable control, we will contact you to arrange an alternative date. No charge will be applied for rescheduling at Nurtura's initiative.
8. Disclaimers
Nurtura's services are provided as organisational and educational support only. We make no representation that any written output will be suitable for legal, financial, health, or care-related decisions. Any reliance placed on written outputs for purposes beyond household organisation is at the client's own discretion.
Nurtura does not warrant that the information recorded in a document index is complete, that all documents recorded exist in the form stated, or that documents noted as intended for replacement will be successfully replaced through the relevant authority.
9. Limitation of Liability
To the extent permitted by Malaysian law, Nurtura's total liability to a client arising from or connected with a service engagement shall not exceed the total fees paid by the client for that engagement.
Nurtura is not liable for any indirect, consequential, or incidental loss, or for any loss arising from a client's decision made on the basis of written outputs.
10. Indemnification
You agree to indemnify Nurtura against any claim, loss, or expense arising from your breach of these Terms, your misuse of written outputs, or any inaccurate information provided to Nurtura during service delivery.
11. Termination
Either party may end a service engagement by written notice. If Nurtura terminates an engagement, a proportional refund of any unused service fees will be provided. If a client terminates the Family Continuity Programme after the first quarter, no refund will be issued for the remaining period.
Sections 8, 9, 10, and 13 survive termination of any service engagement.
12. Governing Law and Disputes
These Terms are governed by the laws of Malaysia. Any dispute arising from or connected with a service engagement will first be referred to informal discussion between the parties. If informal discussion does not resolve the matter within 30 days, either party may refer the dispute to mediation before the Kuala Lumpur Regional Centre for Arbitration or a mediator agreed by both parties.
The courts of Malaysia shall have jurisdiction over any unresolved dispute.
13. General
Entire agreement: These Terms together with any written service description constitute the entire agreement between the parties in relation to the service concerned.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it later.
Assignment: You may not assign your rights under these Terms without our written consent. Nurtura may assign its obligations to a successor business without your consent.
14. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised date. Continued use of our services after an update constitutes acceptance of the revised Terms.
